Tour Conditions Agreement

 

This page outlines what Journey Out agrees to provide when you sign up for a tour, and what you agree to do in return. This is very important information so please read it carefully before you make your deposit.

Included in the price of each tour: accommodations, per-person / double occupancy, transportation and meals as outlined in the tour description. Sales tax will be added as required by law.

 

On our ground tours, you'll want to pack lightly.  Please note that you will always carry your own bags. When traveling by train, you may be required to lift your bag above your head to place it on the luggage rack. In most cases, we travel by public transportation only, including between train stations and our hotel. Your welcome kit includes creative tips for packing lightly.  

 

Our ground tours can be physically demanding. The most active days will have six or more miles of walking, often over cobblestone streets. And if this seems daunting, remember that the exercise balances out the incredible meals you'll have. We come home feeling healthier every time! Those with mobility problems are welcome to use public transportation and private taxis at their own expense. 

 

Tour itineraries are subject to change. All our world-wide destinations are full of surprises and we strive to be flexible enough to take advantage of whatever comes along so we can provide you with the best possible tour. Please note that uncompleted portions of the tour itinerary are not cause for refund.  Individual personal expenses are not subject to reimbursement by Journey Out for any reason without prior agreement with your Tour Director. 

 

Journey Out strongly encourages all Guests to purchase separate travel insurance to cover possible additional costs, such as loss or airline tickets or luggage, trip delay, medical evacuation, etc. We will be happy to recommend an insurance company.

 

Tours cancelled by Journey Out. Although unlikely, your tour may be cancelled due to unforeseen circumstances. If Journey Out cancels a tour you have paid for, the entire amount you have paid to Journey Out will be refunded to you within fourteen days after the tour's cancellation. Once this occurs, Journey Out and its representatives have no other obligations to Guests on cancelled trips. Journey Out is licensed by the State of Washington as a registered seller of travel (Washington State UBI 601 990 598).

 

Disabilities. Any pre-existing physical, mental or emotional disability that may require attention or treatment must be reported in writing prior to the beginning of a tour.

 

Liability. It is our aim to give each of our Guests the best possible service and attention. All Guests should be aware that, in arranging restaurants, transportation, motels, hotels and other accommodations or any other service (“Suppliers”), Journey Out and its agents, employees, officers, directors and affiliates are acting only as agent for the Guest and assume no liability or responsibility for any accident, death, personal injury, illness, property damage, delay or other loss or expense of any nature whatsoever arising directly or indirectly out of any act of God or any actions or omissions of, or default of, any Supplier, programs, or accommodations offered in connection with a tour. All such Suppliers providing tour services, programs or accommodations are independent contractors. Journey Out does not own, manage, control, run or operate any transportation or recreational vehicle (including any motorcoach, boat, helicopter and/or airplane), motel, hotel, restaurant or any other supplier of services. All tour services are subject to the terms and conditions specified by the supplier of such service and to the laws of the countries in which the suppliers are located. 

 

Guests intentionally assume the many risks inherent in foreign travel. By participating in a Journey Out tour, a Guest agrees that Journey Out shall not be liable or responsible for any damages, or any problems concerning any Supplier, programs, or accommodations, resulting directly or indirectly from any occurrences beyond the control of Journey Out, including but not limited to acts of God, casualties, vehicle thefts, natural disasters, labor disputes, theft, equipment breakdowns, cancellations of itinerary, delayed departures and arrivals, missed connections, quarantines, pilferage, weather, government restraints, hijackings, mechanical defects or failures, terrorist acts, or defaults or negligence by any Supplier, programs or accommodations. By participating in a Journey Out tour, the Guest further agrees that Journey Out shall not be responsible or liable for any damages arising out of or relating to any tour, except to the extent arising out of Journey Out’s gross negligence or willful misconduct. 

 

Journey Out reserves the right to make any changes in itineraries, hotels, restaurants, carriers, programs, or any other services without notice that it deems necessary, or to cancel a tour at any time. Journey Out also reserves the right to accept or reject, or terminate or expel, anyone as a tour participant for any reason.

 

By participating in a Journey Out tour, a Guest agrees to be bound by all rules and guidelines established by Journey Out and its representatives and their Tour Director. Each Guest participates in the activities of the tour at such Guest’s own risk. Climbing, hiking, extensive walking, touring in general, use of various transportation and recreational vehicles, and other physical activity may involve greater risk of injury or death than the activities which a Guest may participate in during such Guest’s daily life. By taking part in such activities, a Guest incurs and assumes all of the risks that such activities present. As Journey Out is not qualified to evaluate your fitness, you (or your doctor) must evaluate your fitness for any given tour or activity. Journey Out assumes no liability or responsibility for any damages which may result from a Guest’s participation in any activity during the tour. By allowing a minor to participate in a tour, the parents and / or guardian of the participating minor agree to be solely responsible for the supervision and welfare of the minor on the tour and to ensure that the minor follows all written and verbal rules of safety. The parents  and / or guardian of the participating minor, for themselves and on behalf of the participating minor, hereby release and discharge, and agree to hold harmless, Journey Out from and against any and all damages (including, without limitation, emotional trauma) suffered or incurred by such minor.

 

It is agreed by Journey Out and the Guest that all legal claims, actions and proceedings against Journey Out under, in connection with, resulting from or incident to a tour may be instituted, if at all, only in a state or federal court within the State of Washington, USA, to the exclusion of the courts of or in any other state or jurisdiction. It is further agreed that all such claims, actions and proceedings shall be governed by and decided in accordance with the laws of the State of Washington. In no event shall Journey Out be liable for other than compensatory damages, and you hereby waive all rights to punitive damages. This Tour Conditions Agreement may not be amended or modified except in a writing signed by a duly-authorized representative of Journey Out.

 

Tour payments.  The deposit required to reserve a space on a Journey Out tour is $300 per person (may be higher for a cruise). Final payment is due 90 days before departure. Missing the final payment deadline may result in your being dropped from the tour. If you sign up less than 90 days before departure, full payment will be due immediately and it is non-refundable. Guests requesting roommate matching may be required to pay a single supplement if a roommate cannot be found.

 

Cancellations and refunds. Your deposit will not be refundable for any reason. A tour cancellation made by you 90 or more days before departure will result in a refund of all moneys paid by you minus the non-refundable deposit. No refund is possible for a tour cancellation made by you fewer than 90 days before departure.  All cancellations must be sent in writing via email, fax or mail and will be effective on the date received by Journey Out.  No refund is possible for any person starting but not completing a tour.
